Domain Registration Service Terms
These Domain Registration Service Terms form part of the WeCatchIt Terms & Conditions and apply to all Customers purchasing domain registration, domain transfers or domain management services from WeCatchIt.
By purchasing or using these services, you agree to these Terms.
1. About the Service
WeCatchIt provides domain name registration and management services through accredited third-party domain registrars.
Our services may include:
- Domain Registration
- Domain Transfers
- Domain Renewals
- DNS Management
- Domain Forwarding
- Nameserver Configuration
- Domain Protection
- Domain Management
All domain registrations remain subject to the rules and policies of the relevant domain registry and registrar.
2. Domain Availability
All domain registrations are subject to availability at the time of registration.
Submitting a request does not guarantee that a domain name will be secured.
A registration is only confirmed once the registrar has successfully completed the registration process.
3. Registration Information
Customers agree to provide accurate and complete registration details.
This may include:
- Full Name
- Business Name
- Address
- Telephone Number
- Email Address
Customers are responsible for ensuring this information remains accurate and up to date.
4. Domain Ownership
Unless otherwise agreed in writing:
- The Customer shall be recognised as the beneficial owner of the registered domain.
- Where WeCatchIt registers a domain on behalf of the Customer, administrative or technical contact details may temporarily reference WeCatchIt for management purposes.
- Ownership does not transfer to WeCatchIt simply because we manage the domain.
5. Renewals
Domain names must be renewed before their expiry date.
Where WeCatchIt manages renewals:
- renewal reminders may be issued;
- renewal fees must be paid before the renewal date;
- failure to make payment may result in expiry of the domain.
Expired domains may become available for registration by third parties.
WeCatchIt cannot guarantee recovery of expired domains.
6. Transfers
Customers may request transfer of their domain name at any time, subject to:
- payment of all outstanding invoices;
- completion of any required verification;
- registrar transfer procedures;
- applicable transfer fees.
Transfer times are controlled by the relevant registrars and are outside WeCatchIt's control.
7. DNS Management
Where DNS management is provided, WeCatchIt will take reasonable care when applying requested changes.
Customers acknowledge that DNS updates may take up to 48 hours (or longer in some cases) to fully propagate across the internet.
Temporary interruptions may occur during DNS changes.
8. Third-Party Registrars
All domain registrations are processed through third-party registrars.
WeCatchIt cannot be held responsible for:
- registrar outages;
- registry failures;
- pricing changes imposed by registries;
- domain suspension by registrars;
- registry policy changes.
9. Premium Domains
Some domain names are classified as Premium Domains by registries.
Premium domains may:
- carry higher registration fees;
- have higher renewal costs;
- be subject to additional registry terms.
WeCatchIt is not responsible for registry pricing decisions.
10. Prohibited Domain Use
Customers must not use registered domains to:
- distribute malware;
- send spam;
- conduct phishing attacks;
- promote illegal activities;
- infringe trademarks;
- host unlawful content;
- impersonate another business.
WeCatchIt reserves the right to suspend services where required by law or by the registrar.
11. Customer Responsibilities
The Customer is responsible for:
- monitoring renewal dates;
- maintaining accurate contact details;
- ensuring lawful use of the domain;
- protecting registrar login credentials;
- complying with registry policies.
12. Expired Domains
If a domain expires due to:
- non-payment;
- failure to respond to renewal notices;
- inaccurate contact details;
WeCatchIt shall not be liable for:
- loss of the domain;
- business interruption;
- loss of email services;
- website downtime;
- reputational damage;
- financial loss arising from expiry.
13. Suspension
We reserve the right to suspend domain management services where:
- invoices remain unpaid;
- unlawful activity is identified;
- registrar instructions require suspension;
- these Terms are breached.
Where reasonably practicable, notice will be provided.
14. Intellectual Property
The Customer warrants that any requested domain registration does not knowingly infringe the intellectual property rights of any third party.
WeCatchIt accepts no responsibility for trademark disputes relating to domains selected by the Customer.
15. Limitation of Liability
To the fullest extent permitted by law, WeCatchIt shall not be liable for:
- failure to obtain a requested domain;
- registrar delays;
- registry errors;
- expired domains;
- DNS propagation delays;
- email interruption;
- website downtime caused by domain issues;
- indirect or consequential losses.
Our total liability shall not exceed the fees paid for the relevant domain management service during the 12 months immediately preceding the event giving rise to the claim.
Nothing in these Terms excludes liability which cannot lawfully be excluded under Scots law.
16. Governing Law
These Terms shall be governed by the laws of Scotland.
Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the Scottish Courts.
