Smart Website Terms

These Smart Website Service Terms form part of the WeCatchIt Terms & Conditions and apply to all customers purchasing a Smart Website from WeCatchIt.

By purchasing or using this Service, you agree to these Terms.

1. About the Service

WeCatchIt provides professionally designed Smart Websites tailored to meet the needs of businesses across a range of industries.

Our Smart Websites may include:

• Responsive Website Design
• Mobile Optimisation
• Contact Forms
• Lead Capture
• Smart Chatbots
• Smart Receptionist Integration
• Missed Call Text Back Integration
• CRM Integration
• Booking Systems
• SEO Optimisation
• Google Maps
• Analytics
• Automation Workflows
• Ongoing Maintenance

Available features depend on the package purchased.

2. Project Commencement

Website development will begin once:

• The Customer accepts our quotation.
• Payment has been received (unless otherwise agreed).
• Required information has been supplied.
• Branding materials have been provided.

Project timescales begin once all required information has been received.

3. Customer Responsibilities

The Customer agrees to provide:

• Business information.
• Logos and branding.
• Images and media.
• Written content.
• Contact details.
• Social media links.
• Product or service information.
• Legal policies where required.

The Customer confirms they own, or have permission to use, all materials supplied to WeCatchIt.

4. Delays

Project timelines may be extended where delays are caused by:

• Late content submission.
• Failure to approve designs.
• Requested changes.
• Third-party delays.
• Hosting or domain issues.

WeCatchIt shall not be liable for delays caused by the Customer or third parties.

5. Design Approval

Draft designs will be supplied for approval where applicable.

Once approved:

• development will continue;
• substantial design changes may incur additional charges.

Approval may be provided by email, messaging or other written communication.

6. Revisions

Reasonable revisions are included during development.

Requests outside the agreed project scope may be quoted separately before work begins.

7. Smart Features

Your website may include Smart features such as:

• Smart Chatbots
• Smart Receptionists
• Lead Capture
• Appointment Booking
• CRM Integration
• Smart Automation
• Missed Call Text Back
• Contact Forms

Availability depends on your selected package.

8. Customer Content

The Customer remains responsible for all content supplied.

This includes:

• Images
• Logos
• Videos
• Product descriptions
• Pricing
• Legal policies
• Blog articles

WeCatchIt reserves the right to refuse unlawful, defamatory or offensive material.

9. Website Ownership

The Customer retains ownership of:

• Their business information
• Logos
• Images they supply
• Written content they create

WeCatchIt retains ownership of:

• Website framework
• Source code
• Design systems
• Smart Automation
• Software
• Scripts
• Templates
• Prompt libraries
• CRM workflows
• Integrations
• Internal development tools

Where a website forms part of a subscription package, the Customer receives a licence to use the website during the active subscription period.

Unless expressly agreed in writing, ownership of the underlying website framework and proprietary technology does not transfer to the Customer.

10. Hosting

Where hosting is provided by WeCatchIt:

• We aim for 99.9% uptime.
• Scheduled maintenance may occasionally result in temporary downtime.
• Security updates may be applied without prior notice where necessary.

Hosting availability depends upon third-party infrastructure providers.

11. Domain Names

Where WeCatchIt registers a domain name on behalf of the Customer:

• the domain remains subject to the relevant registrar's terms;
• renewal fees remain payable;
• failure to renew may result in loss of the domain.

WeCatchIt accepts no responsibility for domains that expire due to unpaid renewal fees or incorrect contact information.

12. SEO

Basic technical SEO may be included depending upon the package.

We do not guarantee:

• Google rankings
• Search engine placement
• Website traffic
• Sales
• Enquiries

Search engine algorithms remain outside our control.

13. Third-Party Integrations

Your website may integrate with:

• Google Analytics
• Microsoft Clarity
• Google Maps
• Stripe
• Calendly
• OpenAI
• Twilio
• Zapier
• WhatsApp
• Meta
• CRM systems

We are not responsible for interruptions caused by third-party providers.

14. Security

We implement reasonable security measures including:

• SSL certificates
• Software updates
• Security monitoring
• Firewall protection
• Malware prevention

No website can ever be guaranteed completely secure.

Customers are responsible for safeguarding login credentials.

15. Website Maintenance

Where maintenance is included, WeCatchIt may:

• Apply software updates.
• Improve security.
• Fix technical issues.
• Optimise performance.
• Monitor website health.
• Maintain integrations.

Additional development requests may be quoted separately.

16. Suspension

We reserve the right to suspend hosting or related services where:

• payment is overdue;
• unlawful activity is detected;
• malware compromises the website;
• these Terms are breached.

Where reasonably practicable, notice will be provided before suspension.

17. Limitation of Liability

To the fullest extent permitted by law, WeCatchIt shall not be liable for:

• business interruption;
• loss of profits;
• loss of sales;
• loss of website traffic;
• search engine penalties;
• cyber attacks;
• hosting failures beyond our control;
• third-party outages;
• indirect or consequential losses.

Our total liability shall not exceed the total fees paid by the Customer during the 12 months immediately preceding the event giving rise to the claim.

Nothing in these Terms excludes liability which cannot lawfully be excluded under Scots law.

18. No Guarantee of Results

While our Smart Websites are designed using current best practices, WeCatchIt does not guarantee:

• increased enquiries;
• increased revenue;
• improved search rankings;
• lead generation;
• business growth; or
• uninterrupted website availability.

Business performance depends on many factors outside our control.

19. Governing Law

These Terms are governed by the laws of Scotland.

Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the Scottish Courts.
